These services are not a substitute for professional medical advice, diagnosis, or treatment outside of APS’s telehealth scope, such as non-psychiatric or in-person care. The Services are not intended for emergency medical situations, including suicidal crises or acute mental health emergencies. In such cases, immediately contact 911, a local emergency room, or the National Suicide Prevention Lifeline at 988.
You agree to use the Services only in states where our providers are licensed, currently Arizona, Colorado, Georgia, Illinois, New Mexico, Ohio, Tennessee, and Texas, with additional states added as APS expands. Licensed states are updated at https://advancedpsych-solutions.com/.  Misuse, such as accessing Services from an unlicensed state, providing inaccurate health information, or intercepting/modifying communications or data in an unauthorized manner, may result in termination of access.
By using the Services, you consent to receiving telehealth care, acknowledging its benefits and risks, including potential privacy limitations compared to in-person care.  You are responsible for maintaining sufficient internet access and device functionality to use the Services, as required by our communication platforms.
APS is not liable for outcomes due to patient non-compliance with treatment plans, inaccurate information provided by you, or technical issues beyond our control, such as internet disruptions or failures of HIPAA-compliant third-party platforms (e.g., telehealth software, SMS delivery systems). Services provided under a medical lien agreement may involve delayed payment and attorney coordination, as outlined in Section 18.
Our licensed providers, including psychiatrists and other clinicians, deliver care in accordance with professional standards. By using the Services, you acknowledge that APS’s providers are qualified to provide the care offered within their licensed jurisdictions.APS ensures accessibility of the Services for patients with disabilities, in compliance with the Americans with Disabilities Act (ADA). For telehealth services, applicable state laws where the Patient is located at the time of service may also apply, including but not limited to Arizona, Colorado, Georgia, Illinois, New Mexico, Ohio, Tennessee, Texas, and any additional states where APS operates.

16. Patient Location Acknowledgment:

By using APS’s telehealth services, you agree to be physically located in a state where our providers are licensed at the time of service, currently Arizona, Colorado, Georgia, Illinois, New Mexico, Ohio, Tennessee, or Texas. You must notify us immediately of any location change via info@apsychsolutions.com or our phone number (470) 945-3069 before or during treatment. Failure to comply may result in service interruption or termination to meet state licensing requirements.

17. Medical Liens

If you receive telehealth services under a medical lien agreement, you authorize APS to share health and billing information with your attorney or other parties involved in your legal action, as permitted by HIPAA and outlined in the lien agreement. Such sharing supports payment for services via settlement, judgment, or verdict proceeds.

The Services may involve electronic agreements, including these Terms or medical lien agreements. Electronic signatures shall have the same legal effect as original signatures, in accordance with the Electronic Signatures in Global and National Commerce Act (E-SIGN) and applicable states laws.
